General Provisions

This web site (www.nutramy.com) is the exclusive property of NutraMy SA, Via dei Gorini 2, 6900 Lugano (Switzerland), VAT number CHE-417.146.832 VAT. The products and services contained herein are the exclusive property of NutraMy SA and its subsidiaries. Where not explicitly indicated, companies controlled by NutraMy SA are also identified as “NutraMy” or “NutraMy SA”.

Sales contracts in Switzerland are governed by the Swiss Code of Obligations. Within the European Union, they are governed by Italian law (in particular, by Legislative Decree 206 of 6 September 2005 and by Legislative Decree 70 of 9 April 2003).

The “Customer” is understood to be the person (end-consumer) who purchases the products for personal use. The following are therefore excluded, by way of example: partnerships, corporations, and individuals who complete the purchase as professionals.

The contract is concluded between NutraMy SA or its subsidiaries and the Customer at the time of receipt of the confirmation of acceptance of the order by e-mail.

By submitting the order, the Customer acknowledges and declares to have read the indications provided for the purchase procedure and fully accepts the General Sales Conditions (“General Conditions”).

NutraMy SA is not liable for any type of malfunctioning due to the data transmission network manager.

The Seller

The seller is NutraMy SA or any of its subsidiaries (for example NutraMy Europe S.r.l.). The selling company within NutraMy is identified according to the country of shipment of the product. NutraMy adopts stringent terms for compliance with the legislation on the distribution of its products.

Product Information

The www.nutramy.com site provides the category, description, ingredients, dosage, allergens and other information on each product. Upon request, NutraMy SA is pleased to provide additional information to the Customer (info@nutramy.com)

Each product is supplied with a bar code (GS1), lot, expiry date and other information useful for its identification. 

Prices

Product prices are inclusive of VAT. Transportation is not included in the indicated price. Transportation is free beyond a minimum order amount, variable depending on the shipping address. The minimum purchase amount above which transport is offered by NutraMy SA is indicated at the conclusion of the purchase process.

All prices are initially expressed in Euro (EUR). For purchases made from Switzerland, prices are expressed in Swiss Francs (CHF) and shown before the payment is made.

Orders

To proceed with the purchase, it is necessary to be registered on the web site (before or during the purchase phase of the “Shopping Cart”). The web site indicates the logical steps of the purchase.

Once the product has been chosen and placed in the “Shopping Cart”, the Customer has the possibility to correct any errors in the order (delete a product, add others, change the quantities).

After having read the General Conditions, you can proceed with the payment (“Go to the checkout”). If not previously done, the Customer can register as a new user or proceed with the log-in. The system summarizes the order and the Customer’s data. The various payment systems follow.

The order becomes irrevocable once it is sent.

By sending the order, the Customer acknowledges and declares to have read all the indications provided during the purchase process and to fully accept these General Conditions, the right of withdrawal, and the Privacy Policy.

NutraMy and its subsidiaries reserve the right to accept or decline any order received. NutraMy SA will inform the Customer of the impossibility of accepting the orders received, for any non-discriminatory reason, within 30 (thirty) days from the day after the order was submitted through the web site. In the event of refusal, NutraMy SA or its subsidiaries will reimburse any amounts already paid by the Customer.

Payment Methods

The Customer can pay the price of the products and the relative transport costs by credit card or PayPal, as indicated on the web site, depending on the shipping address.

The transaction will be charged to the Customer’s credit card or via PayPal only after:

the credit card or PayPal data has been verified;

the debit authorization has been received from the issuing company of the credit card used by the Customer or PayPal;

the availability of the product by NutraMy SA or its subsidiaries has been confirmed.

In no case can NutraMy be held responsible for any fraudulent and / or improper use of the credit card or PayPal by third parties at the time of payment.

Products will be shipped only after payment has been made.

In the event that, for any reason, the debit of the amounts due from the Customer proves impossible, the sale will be canceled.

Order Receipt

The Customer will receive, by means of two separate e-mails, the confirmation of receipt of the purchase order and of the shipment.

Shipping

NutraMy and its subsidiaries use independent carriers. In order to ensure a fast and quality delivery, NutraMy has selected reliable carriers. However, NutraMy SA and its subsidiaries cannot guarantee the delivery times and product conditions.

Withdrawal

The Customer has the right to withdraw from the contract, returning the products purchased through the web site, within 14 (fourteen) days from the date of receipt. The right of withdrawal is reserved only to private consumers who act for purposes unrelated to their profession. There is no right of withdrawal for legal and physical persons who, in reference to the purchase contract, act in a professional context.

To exercise the right of withdrawal, the Customer must send, within the term of 14 (fourteen) days from the date of receipt of the products, an e-mail to info@nutramy.com, communicating the will to avail of the right of withdrawal, the indication of the products for which the Customer wants to make use of the right of withdrawal, the order number issued at the time of purchase and the data relating to the Customer’s bank account. The Customer loses the right of withdrawal if the returned product is not complete and in perfect conditions due to the absence, for example, of one or more items ordered or because it has suffered damage not previously reported with the written reservation on the delivery form or if the return procedure is not respected. The return cost is charged to the Customer. The liability of the goods, for damage, theft and loss during shipment, as required by law, are charged to the Customer.

The Customer must execute the shipment within 14 (fourteen) days from the date on which he/she sent the notice of exercise of the right of withdrawal.

Replacement

Replacement of a product is possible. To obtain the replacement of a product, the Customer must send via e-mail (info@nutramy.com) the request to replace the products within 3 (three) days from receipt of the goods. Within 7 (seven) days, he/she must send the product, intact and in its original packaging, with every document received, by means of a forwarding agent of his/her choice. Shipping costs are charged to the Customer.

The shipping addresses for replacement are:

  • NutraMy SA, Via dei Gorini 2, 6900 Lugano (if the product has been shipped in Switzerland)
  • NutraMy Europe S.r.l., Via Ufente 20, 04100 Latina (LT) (if the product has been shipped outside Switzerland)

The execution of the new replacement order is subject to the availability of the requested products. The replacement product will be sent to the Customer by carrier without any further charge.

Defects of Conformity

In case of lack of conformity of the products sold on our web site, the Customer must send a notice to info@nutramy.com. The Customer has the right to restore, without charge, the conformity of the goods by substitution or an adequate price reduction or the termination of the contract. The Customer forfeits these rights if he/she does not report to NutraMy SA or its subsidiaries the lack of conformity within one (1) month from the date on which he/she discovered the defect. The action aimed at asserting the defects not fraudulently concealed by NutraMy SA and its subsidiaries prescribes, in any case, within twenty-five (25) months from the delivery of the goods.

Errors

The product information provided on the web site is constantly updated. However, a complete absence of errors cannot be guaranteed. NutraMy SA reserves the right to correct errors, inaccuracies, omissions or misprints even after an order has been sent and to change or update information at any time without prior notice.

Law and Competent Court

For disputes arising from the interpretation, validity and / or execution of these General Conditions, the mandatory territorial jurisdiction will be that of the place of residence or domicile of the consumer, if located in the Italian territory. In all other cases, the territorial jurisdiction lies with the Court of Lugano.

Responsibilities of auxiliary third parties

NutraMy SA and its subsidiaries are not in any way responsible for the actions of third parties who, as autonomous auxiliaries, intervene in the management or execution of payment transactions, delivery of the goods and any other operation relating to the execution of contracts concluded on www.nutramy.com.
